New EU data protection legislation aims to create a uniform set of rules across the EU fit for the digital era, improve certainty as to the law and boost trust in the digital single market for citizens and businesses alike. The EU Data Protection Regulation is being put into place to take over from the EU Data Protection Directive, which we discussed in our earlier post. Its status as a Regulation rather than a Directive means that when it comes into force it will automatically become the law in the EU, while a Directive requires implementation by individual member states to become the law. The GDPR heralds a new era of data protection. It replaces the existing data protection framework, which was based on an EU directive.
